📌 What to Remember
- CBD is non-intoxicating. Delta-8 THC is not. That is the difference everything else hangs on.
- Delta-8 binds to CB1 receptors and produces a high. CBD does not bind there in the same way.
- In the UK, delta-8 is a controlled drug, covered by the generic definition of tetrahydrocannabinols in the Misuse of Drugs Act 1971.
- CBD is legal to sell in the UK as a food supplement under the FSA novel foods regime.
- Delta-8 occurs naturally only in trace amounts, so commercial delta-8 is almost always converted from CBD in a lab.
This comparison gets muddled because both compounds come from hemp, and a lot of content written for the American market treats them as two flavours of the same thing. They are not. CBD will not get you high and delta-8 THC will, and in the UK that difference is the line between a legal supplement and a controlled drug.
We have been fielding delta-8 questions at TealerLab UK since the American market exploded around 2021, and the answer we give British customers has not changed. Here is the full picture, including the bit most articles skip: where delta-8 actually comes from.

What Is CBD?
CBD, or cannabidiol, is the most abundant non-intoxicating cannabinoid in hemp. It is what the entire legal European hemp market is built on, precisely because it does not produce a high. You can take it and go to work.
The mechanism is worth understanding because it explains the difference in experience. CBD has very low affinity for CB1 receptors, the ones in the brain responsible for cannabis intoxication. Instead it works around the edges of the endocannabinoid system, influencing enzyme activity and interacting with other receptor families. No direct CB1 activation means no high, however much you take.
- Source: extracted directly from hemp flower and biomass, no conversion needed
- Formats: flower, hash, oils, capsules, edibles
- UK category: food supplement, regulated under the FSA novel foods framework
- Testing: every batch we list carries a certificate of analysis, available on request

What Is Delta-8 THC?
Delta-8 THC is an isomer of delta-9 THC, the compound normally meant by "THC". Same molecular formula, but the double bond sits on the eighth carbon rather than the ninth. That small structural shift lowers its binding affinity at CB1, which is why it is consistently described as a milder, more clear-headed high than delta-9.
Milder is not the same as non-intoxicating, and this is where a lot of marketing has been misleading. Delta-8 is psychoactive. It impairs. It will show up on a standard drug test, because screens detect THC metabolites and do not distinguish which isomer produced them.
Now the part that rarely makes it into product descriptions. Hemp produces delta-8 in quantities too small to extract economically, typically well under one percent. Essentially all commercial delta-8 is made by taking CBD extract and isomerising it with acid catalysts. That is a chemical conversion, not an extraction, and the quality of the finished product depends entirely on how thoroughly residual reagents and unintended by-products are cleaned up afterwards. Independent testing in the US market has repeatedly found products containing compounds that were never on the label.
For the isomer comparison people usually want next, our guide to delta-8 vs delta-9 goes deeper on the potency question.
CBD vs Delta-8: Key Differences
1. Intoxication
The headline difference. CBD does not produce a high at any realistic amount. Delta-8 does, reliably. If you are choosing between them, you are really choosing whether you want to be impaired, and everything else is secondary to that.
2. Origin and processing
CBD is extracted. Delta-8 is synthesised from CBD. One is a purification process, the other is a chemical reaction. That matters for purity risk: an extraction can concentrate contaminants already present, while a conversion can introduce entirely new ones.
3. Legal position in Britain
CBD is a legal food supplement here. Delta-8 is a controlled drug. The Misuse of Drugs Act 1971 uses a generic definition covering tetrahydrocannabinols and their isomers, which captures delta-8 without needing to name it. The American regulatory gap that created the delta-8 boom never existed in UK law.
4. Drug testing
Standard workplace screens look for THC-COOH, the metabolite produced by THC isomers generally. Delta-8 produces it. CBD does not, although full spectrum CBD products contain trace delta-9 that can register on sensitive tests with heavy use. Different risk levels, not the same risk.
5. Tolerance and daily use
Delta-8 builds tolerance the way other CB1 agonists do, so regular users tend to need more over time. CBD does not appear to work that way, which is why people use it as part of a routine rather than escalating.
Effects Compared
| Aspect | CBD | Delta-8 THC |
|---|---|---|
| High | None | Yes, moderate |
| Mental clarity | Unaffected | Impaired |
| Driving and machinery | Generally unaffected | Unsafe, and illegal while impaired |
| Appetite change | Minimal | Reported, similar to delta-9 |
| Onset (inhaled) | Minutes | Minutes |
| Duration | A few hours | Several hours, often longer when eaten |
| Anxiety at high doses | Rarely reported | Reported, though less than delta-9 |
Something our team has noticed from years of customer questions: a lot of people who ask about delta-8 are not actually chasing a high. They want the plant, the ritual and the terpenes, and they have been told delta-8 is the legal way to get it. In the UK that premise is simply wrong, and compliant hemp flower gives them what they were describing anyway. Our CBD flower range is where that conversation usually ends.
Legal Status in the UK and EU
Worth being unambiguous, because there is a lot of bad information circulating.
- Delta-8 in the UK: controlled. The Misuse of Drugs Act 1971 covers tetrahydrocannabinols generically, including isomers, so delta-8 carries the same Class B status as delta-9. Possession and supply are criminal offences.
- Delta-8 in the EU: restricted across member states, with several explicitly adding it to controlled substance lists in recent years. There is no reliable pan-European legal route.
- CBD in the UK: legal as a food supplement where the product appears on the FSA novel foods public list and stays within exempt product limits for controlled cannabinoids, capped at 1mg per container under the Misuse of Drugs Regulations 2001.
- CBD in the EU: legal, with hemp cultivation limited to approved varieties below the 0.3% delta-9 THC threshold.
We do not sell delta-8 to UK customers and we are not able to. Anyone shipping it into Britain is exposing you to the legal risk, not themselves.
If the legal picture here is what brought you in, two further guides go deeper on the underlying plant. Our hemp vs weed comparison explains why the 0.3% THC threshold is the only thing separating a legal crop from a controlled one, and our indica vs sativa guide covers what actually predicts the character of a flower once you are shopping inside that legal limit.
For adults 18+ only. Compliant with UK and EU regulations (< 0.3% THC). Not approved by the MHRA to diagnose, treat, or prevent any disease. This article is educational and is not medical advice.
Which One Should You Choose?
Scenario 1: You are in the UK and want something legal
CBD, and it is not close. Delta-8 is not a legal alternative here regardless of how it is marketed. Have a look at what our customers actually buy in our best sellers if you want a shortcut.
Scenario 2: You are drug tested at work
Avoid delta-8 entirely, and be careful even with full spectrum CBD. Trace delta-9 in full spectrum products can register on sensitive screens with regular use. If your job depends on it, that trace matters.
Scenario 3: You want the plant experience without impairment
This is the largest group we speak to, and compliant hemp flower is the honest answer. You get the terpenes, the ritual and the flavour without the intoxication or the legal exposure.
Conclusion
Bottom line: CBD and delta-8 are not two versions of the same product. One is a non-intoxicating supplement that is legal to buy in Britain, the other is a lab-converted THC isomer that is a controlled drug here. The American framing of delta-8 as legal hemp does not survive contact with UK law.
That is the TealerLab way: we would rather tell you what you cannot legally have than sell you something that lands you in trouble. Lab-tested, honestly labelled, certificates on request.
Frequently Asked Questions
Is delta-8 legal in the UK?
No. It falls under the generic definition of tetrahydrocannabinols in the Misuse of Drugs Act 1971, which makes it a Class B controlled drug regardless of the source material it was made from.
Can you fail a drug test from CBD alone?
Pure CBD isolate should not trigger a positive. Full spectrum products contain trace delta-9 THC, and with heavy daily use that can accumulate enough to register on a sensitive screen. It is uncommon but not impossible.
Why is delta-8 made from CBD rather than extracted?
Because hemp produces it in quantities far too small to harvest economically. Isomerisation of CBD is the only commercially viable route, which is why delta-8 is best described as semi-synthetic.
Does delta-8 have the same side effects as delta-9?
Broadly similar in kind, generally reported as less intense in degree. Users report dry mouth, red eyes, altered appetite and impaired coordination. Anxiety is reported less often than with delta-9, though it still occurs.
How can I tell if a CBD product is legitimate in the UK?
Check for a batch-specific certificate of analysis from an independent lab, confirm the product appears on the FSA novel foods public list, and be wary of any seller making health claims. Those three checks filter out most of the market.
Is delta-8 safer than delta-9 because it is weaker?
Lower potency is not the same as greater safety. The main safety concern with delta-8 has been manufacturing quality rather than the molecule itself, given that conversion chemistry can leave residual reagents and unintended by-products in an unregulated supply chain.
